TERMS OF SERVICE

Parties:

  • “We,” “Us,” or “AUTO SALES CHINA” refers to AUTO SALES CHINA, a China-based vehicle export enterprise operating under autosalesnow.com.
  • “You” or “Client” refers to any dealer, distributor, fleet operator, government agency, corporate buyer, or individual importer engaging with our services.

1. ACCEPTANCE OF TERMS

By accessing autosalesnow.com, submitting an inquiry, requesting a quotation, or entering into a purchase agreement with AUTO SALES CHINA, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable export laws. If you do not agree, do not use our services.

2. SERVICES PROVIDED

AUTO SALES CHINA offers the following core services:

  • Export of new Chinese-manufactured vehicles (EVs, hybrids, gasoline; SUVs, sedans, pickups, commercial)
  • Factory-direct procurement from authorized OEM partners
  • Competitive FOB/CIF pricing based on Incoterms® 2020
  • Bulk and wholesale supply coordination
  • Pre-shipment inspection and quality verification
  • End-to-end export documentation (Certificate of Origin, Commercial Invoice, Packing List, Bill of Lading, conformity certificates)
  • Global logistics and shipping coordination (RORO, containerized)
  • Post-delivery support and warranty facilitation

All services are B2B-focused. Retail consumer sales are not offered.

3. ELIGIBILITY & REPRESENTATIONS

You confirm that:

  • You are a legally recognized business entity, government body, or qualified importer in your jurisdiction.
  • You possess valid import licenses, homologation approvals, and regulatory compliance for vehicle imports in your destination country.
  • You understand that AUTO SALES CHINA acts as an export intermediary—not a manufacturer—and does not alter vehicle specifications.
  • You will not resell vehicles in China or violate any sanctions (e.g., OFAC, UN).

4. QUOTATIONS & ORDER PROCESS

  • Quotations are valid for 14 days and based on FOB Shanghai or CIF [Port] terms unless stated.
  • Order Confirmation requires a signed Proforma Invoice and deposit (typically 30%).
  • Specifications (model, color, trim) must be finalized before production allocation. Changes post-allocation may incur fees.
  • Pricing excludes destination-country duties, taxes, registration, or homologation costs.

5. PAYMENT TERMS

  • Deposit: 30% upon order confirmation via irrevocable LC or bank transfer.
  • Balance: 70% due before shipment, against copy of shipping documents.
  • Currency: USD only. Late payments incur 1.5% monthly interest.
  • Refunds: Deposits are non-refundable after factory allocation. Cancellations post-inspection forfeit 100%.

6. EXPORT COMPLIANCE & DOCUMENTATION

  • We provide standard export docs compliant with Chinese customs and international trade standards.
  • Client Responsibilities: You must secure:
    • Import permits
    • Homologation (e.g., GCC, ECE, EPA/DOT if applicable)
    • Destination customs clearance
  • We are not liable for delays/costs due to your non-compliance with local regulations.

7. INSPECTION & QUALITY

  • All vehicles undergo pre-shipment inspection per OEM standards.
  • Clients may appoint a third-party inspector (e.g., SGS, Bureau Veritas) at their cost.
  • Claims for visible defects must be filed within 48 hours of port arrival with photographic evidence.
  • No claims accepted for: market-driven feature changes, minor cosmetic variances, or post-delivery modifications.

8. SHIPPING & DELIVERY

  • Lead Time: 30–60 days post-payment, subject to OEM production schedules.
  • Risk Transfer: Per Incoterms® 2020 (e.g., FOB = risk passes at port of loading).
  • Delays: Force majeure events (port strikes, pandemics, war) extend timelines without penalty.
  • Tracking: Real-time updates provided via email.

9. WARRANTY & AFTER-SALES

  • Vehicles carry original OEM warranties (valid per manufacturer terms in your region).
  • We facilitate warranty claims but do not administer repairs.
  • Post-delivery support includes:
    • Technical spec sheets
    • Spare parts sourcing coordination
    • Documentation reissuance (fee applies)

10. INTELLECTUAL PROPERTY

All content on autosalesnow.com (logos, images, specs) is owned by AUTO SALES CHINA or its OEM partners. You may not reproduce, reverse-engineer, or use for unauthorized resale listings.

11. LIMITATION OF LIABILITY

  • Maximum liability = total payment received for the affected order.
  • We are not liable for:
    • Indirect/consequential damages (lost profits, downtime)
    • Regulatory penalties in your jurisdiction
    • Acts of third parties (carriers, customs brokers)

12. GOVERNING LAW & DISPUTES

  • Governing Law: Laws of the People’s Republic of China.
  • Dispute Resolution: Mediation in Shanghai. Unresolved disputes settled via CIETAC arbitration.
  • Language: English prevails in all contracts.

13. TERMINATION

We may terminate service if you:

  • Breach payment terms
  • Misrepresent your business status
  • Violate export controls
    Outstanding payments remain due upon termination.

14. GENERAL PROVISIONS

  • Amendments: Posted on autosalesnow.com with 30-day notice.
  • Severability: If any clause is unenforceable, the rest remains valid.
  • Waiver: Failure to enforce a right is not a waiver.
  • Entire Agreement: Supersedes all prior discussions.
